This testimony, subject to criminal penalties for lying to Congress, was not ‘partisan.’ It was truthful. “Every member of the Select Committee supported the creation of an independent bipartisan commission. After initially supporting such a commission, Leader McCarthy withdrew his support and the bipartisan plan to create the commission was defeated by Republicans in the Senate. The Select Committee was formed only after the proposal for an outside commission was defeated. “Leader McCarthy had the opportunity to nominate five members of the Select Committee. Speaker Pelosi initially accepted three of those nominees and invited Leader McCarthy to propose two others. Rather than doing so, McCarthy chose to withdraw all his nominees and refused to participate at all—so that he could make the false claim that the Committee was entirely one-sided. This was a cynical choice by Mr. McCarthy. In fact, both the Vice Chair and Representative Kinzinger are Republicans. |

Links to the subpoenas: Minority Leader Kevin McCarthy was in communication with President Trump before, during, and after the attack on January 6th. Mr. McCarthy was also in communication with other members of the White House staff during the attack and in the days before and after January 6th concerning the events at the Capitol. Mr. McCarthy also claimed to have had a discussion with the President in the immediate aftermath of the attack during which President Trump admitted some culpability for the attack. Representative Scott Perry was directly involved with efforts to corrupt the Department of Justice and install Jeffrey Clark as acting Attorney General. In addition, Mr. Perry had various communications with the White House about a number of matters relevant to the Select Committee’s investigation, including allegations that Dominion voting machines had been corrupted. Representative Jim Jordan was in communication with President Trump on January 6th and participated in meetings and discussions throughout late 2020 and early 2021 about strategies for overturning the 2020 election. Representative Andy Biggs participated in meetings to plan various aspects of January 6th and was involved with plans to bring protestors to Washington for the counting of Electoral College votes. Mr. Biggs was involved in efforts to persuade state officials that the 2020 was stolen. Additionally, former White House personnel identified Mr. Biggs as potentially being involved in an effort to seek a presidential pardon for activities connected with the former President’s efforts to overturn the 2020 presidential election. Representative Mo Brooks spoke at the rally on January 6th, encouraging rioters to “start taking down names and kicking ass.” In addition, Mr. Brooks has publicly described conversations in which the former President urged him to work to “rescind the election of 2020” and reinstall Mr. Trump as President. The Select Committee also has evidence that Mr. Brooks’s staff met with members of Vice President Pence’s staff before January 6th and conveyed the view that the Vice President does not have authority to unilaterally refuse to count certified electoral votes. |

Laura Cox reportedly witnessed Rudy Giuliani pressure state lawmakers to disregard election results in Michigan and say that certifying the election results would be a “criminal act.” Mark W. Finchem advanced unsubstantiated claims about the election and helped organize an event in Phoenix, Arizona on November 30th, 2020 at which former President Trump’s legal team and others spoke and advanced unproven claims of election and voter fraud. He was in Washington on January 6th, 2021 and stated that he had evidence to deliver to Vice President Pence in an effort to postpone the awarding of electors. Kelli Ward reportedly spoke to the former President and members of his staff about election certification issues in Arizona and acted to transmit documents claiming to be an “alternate” Electoral College elector from Arizona. |

These facts are directly relevant to our inquiry. Similarly, on January 5th, the night before the violent riot, you sent and received a stream of texts. You wrote: “Im very worried about the next 48 hours.” With the counting of the electoral votes scheduled for January 6th at 1 p.m., why were you concerned about the next 48 hours? Also, on the evening of January 5th, you texted Mr. Meadows: “Pence pressure. WH counsel will leave.” What communications or information led you to conclude that White House Counsel would leave? What precisely did you know at that time? It also appears from other text messages that you may have had a conversation directly with President Trump on the evening of January 5th (and perhaps at other times) regarding his planning for January 6th. Each of these non-privileged communications is directly relevant to our investigation. Likewise, as you know from the Select Committee’s recent meetings, we are aware of and interested in your communications to Mr. Meadows and others during the violent attack on January 6th, as the rioters were attempting to occupy the Capitol building. For example, we have your text to Mr. Meadows advising that President Trump should “… Ask people to peacefully leave the [C]apit[o]l.” President Trump did not do so until 4:17 p.m. that day. Likewise, later on January 6th, you texted to Meadows press coverage relating to a potential effort by members of President Trump’s cabinet to remove him from office under the 25th Amendment. As you may recall, Secretaries DeVos and Chao both resigned following the President’s conduct on January 6th, as did members of the President’s White House staff. We would like to question you regarding any conversations you had with Mr. Meadows or others about any effort to remove the President under the 25th Amendment. Additionally, you appear also to have detailed knowledge regarding President Trump’s state of mind in the days following the January 6th attack. Members of Proud Boys International, L.L.C., called for violence leading up to January 6th, and at least 34 individuals affiliated with the Proud Boys have been indicted by the Department of Justice in relation to the January 6th attack on the Capitol. Many individuals associated with the Proud Boys repeatedly spread the former President’s unsupported claim that the 2020 election was stolen and suggested the use of force against police officers and government officials. Henry “Enrique” Tarrio was Chairman of the Proud Boys during the January 6th attack on the Capitol. Though Mr. Tarrio was prevented from entering Washington, D.C., on January 6th, he was allegedly involved in the Proud Boys’ preparation for the events at the Capitol. Individuals associated with the Oath Keepers organization were similarly involved in planning and participating in the violent attack on the Capitol on January 6th. Eighteen members of the Oath Keepers were indicted by a federal grand jury for allegedly planning a coordinated attack to storm the Capitol, including by traveling to Washington, D.C., with paramilitary gear and supplies. Elmer Stewart Rhodes is President of the Oath Keepers. Prior to January 6th, Mr. Rhodes repeatedly suggested the Oath Keepers should engage in violence to ensure their preferred election outcome. On January 6th, Mr. Rhodes was allegedly in contact with several of the indicted Oath Keepers members before, during, and after the Capitol attack, including meeting some of them outside the Capitol. 1st Amendment Praetorian is an organization that provided security at multiple rallies leading up to January 6th that amplified the former President’s unsupported claim that the election was stolen. On January 4th, the 1st Amendment Praetorian Twitter account suggested that violence was imminent. Robert Patrick Lewis, Chairman of 1st Amendment Praetorian, was listed as a speaker on the permit for the January 5th rally on Freedom Plaza. On January 6th, Mr. Lewis tweeted: “Today is the day that true battles begin.” The day after, Mr. Lewis claimed that he was involved in “war-gaming” to continue efforts to overturn the election results. |

Dustin Stockton, who reportedly assisted in organizing a series of rallies after the November 2020 election advancing unsupported claims about the election’s outcome, including the rally at the Ellipse on January 6th immediately preceding the attack on the U.S. Capitol. Mr. Stockton reportedly was concerned that the rally at the Ellipse would lead to a march to the Capitol that would mean “possible danger” which he said “felt unsafe,” and these concerns were escalated to White House Chief of Staff Mark Meadows. Jennifer Lawrence, who along with her fiancé, Mr. Stockton, reportedly was involved in organizing rallies following the November 2020 Election, including the Ellipse rally in Washington, DC on January 6th that immediately preceded the violent attack on the Capitol. Taylor Budowich, who reportedly solicited a 501c(4) organization to conduct a social media and radio advertising campaign encouraging attendance at the January 6th Ellipse rally and advancing unsupported claims about the result of the election. Roger Stone was reportedly in Washington on January 5th and 6th, spoke at rallies on January 5th, and was slated to speak at the January 6th rally at the Ellipse that directly preceded the violent attack on the Capitol. Before traveling to Washington, Mr. Stone promoted his attendance at the rallies and solicited support to pay for security through the website stopthesteal.org. While in Washington, Mr. Stone reportedly used members of the Oath Keepers as personal security guards, at least one of whom has been indicted for his involvement in the attack on the Capitol. Mr. Stone has made remarks that he was planning to “lead a march to the Capitol” from the Ellipse rally. Alex Jones reportedly helped organize the rally at the Ellipse on January 6th that immediately preceded the attack on the Capitol, including by facilitating a donation to provide what he described as “eighty percent” of the funding. Mr. Jones spoke at the January 5th rally on Freedom Plaza that was sponsored by the Eighty Percent Coalition. Mr. Jones has stated that he was told by the White House that he was to lead a march from the January 6th Ellipse rally to the Capitol, where President Trump would meet the group and speak. Mr. Jones has repeatedly promoted unsupported allegations of election fraud, including encouraging individuals to attend the Ellipse rally on January 6th and implying he had knowledge about the plans of the former President with respect to the rally. |

The letters to the witnesses: Nicholas Luna, who served as the former President’s personal assistant, was reportedly in the Oval Office the morning of January 6th, 2021, when the former President was on a phone call to Vice President Pence pressuring him not to certify the results of the 2020 presidential election. Molly Michael, who served as Special Assistant to the President and Oval Office Operations Coordinator, was involved in sending information about alleged election fraud to various individuals at the direction of President Trump, according to information obtained by the Select Committee. Benjamin Williamson, who served as Deputy Assistant to the President and Senior Advisor to Chief of Staff Mark Meadows, was reportedly contacted by a former White House official during the attack on the U.S. Capitol who urged him and Mr. Meadows, without success, to have the former President issue a statement addressing the attack and condemning the violence. Christopher Liddell, former White House Deputy Chief of Staff, was in the White House on January 6th and reportedly considered resigning on that day but stayed on “after a great deal of persuasion.” John McEntee, former White House Personnel Director, was reportedly present in the Oval Office when Rudolph Giuliani, Justin Clark, the former President, and former Vice President Pence discussed the audit process in Georgia and listened as Mr. Giuliani suggested seizing Dominion voting machines because of alleged fraud. Mr. McEntee was also reportedly involved in communications with officials in various federal agencies regarding loyalty to President Trump and specifically discouraged a number of individuals from seeking employment after the election as it would appear to be a concession of President Trump’s defeat. In addition, according to reports, Mr. McEntee was in the White House on January 6th and was with former President Trump when he traveled to the Ellipse and spoke at the “Stop the Steal” rally. Keith Kellogg, who served as Vice President Pence’s National Security Advisor, reportedly participated in at least one January 2021 meeting with the former President and Pat Cipollone during which the former President insisted that former Vice President Pence not certify the election. He was reportedly in the White House with the former President as he watched the January 6th attack unfold and has direct information about the former President’s statements about and reaction to the insurrection. During that day, it is reported that Lt. Gen. Kellogg met with the former President and others before the rally at the Ellipse and then, after the rally, he urged the former President to send out a tweet to his supporters at the U.S. Capitol to help control the crowd. Kayleigh McEnany, former White House Press Secretary, made multiple public statements from the White House and elsewhere about purported fraud in the November 2020 election. For example, in the first White House press conference after the election, Ms. McEnany claimed that there were “very real claims” of fraud that the former President’s reelection campaign was pursuing, and said that mail-in voting was something that “we have identified as being particularly prone to fraud.” At another press conference, Ms. McEnany accused Democrats of “welcoming fraud” and “welcoming illegal voting.” In addition, Ms. McEnany was reportedly present at times with the former President as he watched the January 6th attack. Stephen Miller, who served as Senior Advisor to the former President, by his own account participated in efforts to spread false information about alleged voter fraud in the November 2020 election, as well as efforts to encourage state legislatures to alter the outcome of the November 2020 election by appointing alternate slates of electors. Cassidy Hutchinson, who served as Special Assistant to the President for Legislative Affairs, reportedly was at the White House on January 6th and was with the former President when he spoke at the “Stop the Steal” rally that day. She also reportedly reached out directly via email and phone to Georgia Deputy Secretary of State Jordan Fuchs relating to a trip to Georgia by White House Chief of Staff Mark Meadows to attend an election audit. Kenneth Klukowski, former Senior Counsel to Assistant Attorney General Jeffrey Clark, was involved in drafting a letter that urged legislatures in certain states to delay certification of the election, according to the report recently released by the Senate Committee on the Judiciary. The report also states that Mr. Clark contacted Mr. Klukowski to prepare for an Oval Office meeting with the former President that took place on January 3rd, 2021. |
11.8.2021 | January 6 Select Committee has issued subpoenas to six individuals involved in efforts to promote false claims of election fraud or overturn the results of the 2020 election. William Stepien served as manager of the Trump 2020 reelection campaign. The campaign reportedly urged state and party officials to affect the outcome of the November 2020 election by asking states to delay or deny certification of electoral votes and by sending multiple slate of electoral votes to the United States Congress. Jason Miller, a Senior Advisor to former President Trump’s 2020 reelection campaign, spread the false claim that the November 2020 had been tainted by widespread fraud. Even before the election, Mr. Miller publicly claimed that Democrats would “steal” the election, a message that individuals who attacked the U.S. Capitol echoed on January 6th. After the election, Mr. Miller coordinated with Mr. Trump and Rudolph Giuliani, and claimed in public press events that the election was rigged. Additionally, according to public reports, Mr. Miller participated in a meeting on January 5th, 2021 at the Willard Hotel in Washington, D.C., in which Mr. Giuliani, Stephen Bannon, and others discussed options for overturning the results of the November 2020 election by, among other things, pressuring Vice President Pence to not certify the electoral college results. Angela McCallum, national executive assistant to former President Trump’s 2020 re-election campaign, reportedly participated in efforts to spread false information about alleged voter fraud in the November 2020 election and to encourage state legislatures to alter the outcome of the November 2020 election. Specifically, there is a publicly available recording of a voicemail that Ms. McCallum reportedly left for an unknown Michigan state representative. In the recording, Ms. McCallum wanted to know whether the Trump campaign could “count on” the representative and said that the individual had the authority to appoint an alternate slate of electors based on purported evidence of widespread election fraud. John Eastman reportedly advised President Trump and others that Vice President Pence could reject electors from certain states in order to deny Joe Biden a majority of the Electoral College vote. In the days before January 6th, Mr. Eastman is reported to have participated in a briefing for nearly 300 state legislators regarding purported election fraud, during which he told the group that it was “the duty of the[] legislatures to fix this, this egregious conduct, and make sure that we’re not putting in the White House some guy that didn’t get elected.” Mr. Eastman reportedly participated in the January 5th, 2021 meeting at the Willard Hotel in Washington, D.C. and he spoke at the rally on the Ellipse on January 6th prior to the attack on the U.S. Capitol. Michael Flynn reportedly attended a December 18th, 2020 meeting in the Oval Office during which participants discussed seizing voting machines, declaring a national emergency, invoking certain national security emergency powers, and continuing to spread the false message that the November 2020 election had been tainted by widespread fraud. The day before, Flynn gave an interview on Newsmax TV during which he talked about seizing voting machines, foreign influence in the election, and the purported precedent for deploying military troops and declaring martial law to “rerun” the election Bernard Kerik reportedly participated in the January 5th, 2021 meeting at the Willard Hotel in Washington, D.C. Mr. Kerik reportedly paid for rooms and suites in Washington, D.C. hotels that served as election-related command centers, and also worked with Mr. Rudolph Giuliani to investigate allegations of voter fraud and promote baseless litigation and “Stop the Steal” efforts. Select Committee to Investigate the January 6th Attack on the United States Capitol will move to hold Bannon in criminal contempt for not complying with Committee subpoena: “Mr. Bannon has declined to cooperate with the Select Committee and is instead hiding behind the former President’s insufficient, blanket, and vague statements regarding privileges he has purported to invoke. We reject his position entirely. The Select Committee will not tolerate defiance of our subpoenas, so we must move forward with proceedings to refer Mr. Bannon for criminal contempt. I’ve notified the Select Committee that we will convene for a business meeting Tuesday evening to vote on adopting a contempt report. “The Select Committee will use every tool at its disposal to get the information it seeks, and witnesses who try to stonewall the Select Committee will not succeed. All witnesses are required to provide the information they possess so the Committee can get to the facts. We’re grateful to the many individuals who are voluntarily participating and to witnesses who are complying with subpoenas, including several who met the deadline to begin producing materials to the Select Committee. We’re moving ahead quickly to get answers for the American people about what happened on January 6th and help secure the future of American democracy.” Background: Any person who willfully refuses to provide testimony or documents subpoenaed by Congress, including committees of the House, is potentially liable for contempt of Congress under 2 U.S.C. §§ 192, 194. Contempt of Congress is a crime that may result in a fine and between one and twelve months imprisonment. Contempt of Congress begins with a “formal action” by the Select Committee, i.e., a business meeting at which a contempt report is adopted. If a witness fails to appear, produce documents, or refuses to answer any question “pertinent to the question under inquiry,” the Select Committee then writes a report documenting the inquiry, the attempts to accommodate the witness’s production or testimony, and the failure by the witness to appear, produce, or answer a pertinent question. The report also contains the text of the resolution recommending the full House hold the witness in contempt. After the Select Committee has adopted a contempt report, it is referred to the House for a vote and, upon its adoption, the Speaker certifies the report to the United States Attorney for the District of Columbia. Under 2 U.S.C. § 194, following such certification it is the “duty” of the United States Attorney to “bring the matter before the grand jury for its action. |

Select Committee issues subpoenas for Trump aids and advisors: former Trump White House chief of staff Mark Meadows, former deputy chief of staff Dan Scavino, former adviser Steve Bannon and Kash Patel, a former chief of staff to then-acting Secretary of Defense Christopher Miller who had also served as an aide to Republican Rep. Devin Nunes. Letters to the four witnesses: Press Release: “The Committee is investigating the facts, circumstances, and causes of the January 6th attack and issues relating to the peaceful transfer of power, to identify and evaluate lessons learned and to recommend corrective laws, policies, procedures rules, or regulations,” wrote Chairman Thompson, underscoring the Select Committee’s authority established by House Resolution 503. While serving as White House Chief of Staff, Mark Meadows reportedly communicated with officials at the state level and in the Department of Justice as part of an effort to overturn the results of the 2020 election or prevent the election’s certification. According to other reporting, Mr. Meadows was also in communication with organizers of the January 6 rally, including Amy Kremer of Women for America First. The Select Committee has previously sought White House records dealing with Mr. Meadows, including his actions and communications and information he received dealing with the results and integrity of the 2020 election. Reporting indicates that former White House Deputy Chief of Staff for Communications Daniel Scavino was with the former President on January 5th during a discussion of how to convince Members of Congress not to certify the election for Joe Biden. Prior to the January 6th March for Trump, Mr. Scavino promoted the event on Twitter, encouraging people to “be a part of history.” And records indicate that Mr. Scavino was tweeting messages from the White House on January 6, 2021. At the time of the January 6th attack, Kashyap Patel was serving as chief of staff to Acting Secretary of Defense Christopher Miller. The former President had appointed Mr. Patel to this position on November 10, the day after then-Secretary of Defense Mark Esper was replaced. According to documents provided by the Defense Department and published accounts, Mr. Patel was involved with discussions among senior Pentagon officials prior to and on January 6th, 2021, regarding security at the Capitol, and told a reporter that he was talking to Mr. Meadows “nonstop that day.” The Select Committee has previously sought information about steps taken at the Pentagon to protect the national security both before and after January 6th, including Mr. Patel’s role and his communications with other Pentagon officials. It has also been reported that the former President attempted to install Mr. Patel as Deputy Director of the Central Intelligence Agency in early December, but that planned appointment was abandoned after then-CIA Director Gina Haspel threatened to resign. The Select Committee has previously sought records related to potential or actual personnel changes in the last months of the previous administration, including Mr. Patel’s appointment at the Defense Department and his reported potential appointment at CIA. Stephen Bannon reportedly communicated with former President Trump on December 30th, 2020, urging him to focus his efforts on January 6th. Mr. Bannon also reportedly attended a gathering at the Willard Hotel on January 5th, 2021, as part of an effort to persuade Members of Congress to block the certification of the election the next day. Mr. Bannon is also quoted as stating, on January 5th, that “[a]ll Hell is going to break loose tomorrow.” The subpoenas instruct the witnesses to appear at depositions on the following dates:
